The Texas graduated licensing path

1. Phase 1 - Learner license — from age 15

   Requirements: Complete 6 hours of classroom instruction in a concurrent driver education program, or all 24 classroom hours in a block driver education program, then pass the knowledge exam. Hold the learner license at least 6 months.

   Restrictions: A licensed driver 21+ must be in the front passenger seat at all times. No wireless devices.

2. Phase 2 - Provisional license — from age 16

   Requirements: Hold the learner license 6 months, complete driver education, log 30 supervised hours (10 at night), and pass the driving test.

   Restrictions: For the first 12 months: no driving midnight-5 a.m. (except work, school, or emergency), no more than one passenger under 21 who is not family, and no wireless devices.

3. Full license — from age 18

   Requirements: Provisional restrictions end at age 18.

Texas seat belt rule

In Texas, the driver and every passenger must wear a safety belt, no matter where they sit or how old they are. A child under 8 must be in an approved car seat unless they are taller than 4 feet 9 inches.

Texas speed rule

Texas posts both minimum and maximum speed limits, and the basic speed law still applies: you may never drive faster than is safe and prudent for the conditions, even if you are under the posted limit.

Texas alcohol and phone laws

In Texas, a driver 21 or older is legally intoxicated at a BAC of 0.08. For anyone under 21, zero tolerance means any detectable amount of alcohol can cost them their license. Drivers under 18 may not use a wireless device at all while driving - not even hands-free - except in an emergency.

Texas School Bus & Pedestrian Rules

Stop when approaching a school bus from either direction if it is displaying alternately flashing red lights. Watch for pedestrians and yield at uncontrolled intersections, on a WALK signal, on green when there is no pedestrian control signal, and if the light changes after a pedestrian enters the crosswalk.

When an emergency medical vehicle, law enforcement vehicle, fire truck, tow truck, or TxDOT vehicle is stopped with its lights activated, reduce your speed to 20 mph below the speed limit or move out of the closest lane if multiple lanes travel in the same direction.
